Under the EU AI Act a deep fake means AI-generated or manipulated image, audio or video content that resembles existing persons, objects, places, entities or events and would falsely appear to a person to be authentic or truthful. The deployer disclosure duty in Article 50(4) attaches to content constituting a deep fake. The duty in Article 50(1), that a person is informed they are interacting with an AI system, is owed to natural persons and is not limited to people outside the deploying company.

The evidence
(14) Where the deployer of an AI system is a legal person under whose authority the system is used (e.g. an advertising company), the individual employees that act under the instructions and under the control of that legal person [...] should not be considered as separate deployers for that system. A legal person remains a deployer even if it involves third parties (e.g. contractors, freelancers) in the operation of the system.
